Re: Orange Co. Cops and Mexican ID's
(Note: The Orange Co. Sheriff, Mike Carona, and Orange Co. police chiefs recently met secretly and agreed to accept ID's issued by the Mexican Consulate to illegal aliens... criminals by definition... when dealing with Mexicans who have no U.S. ID's because they are unlawfully present in the U.S. These lawless cops are aiding and abetting illegal aliens.)

I recently had a telephone conversation with the Chief of the Laguna Beach Police Department regarding the new policy of accepting Mexican government issued identification cards. I asked the chief if this new policy in any way removes any discretion from the street officers in arresting suspected illegal aliens. The chief replied "No, there is not a law that requires a person to carry identification anyway". The chief then went on to say this new policy simply allows the officers to easily identify people. I once again asked him if the new policy in anyway restricts an officers discretion. He once again stated "No".
What the chief did not know was the person he was talking to has a strong working knowledge of the California Vehicle Code. I asked the chief if he had ever heard of California Vehicle Code section 40302(A)-(D). He stated "No". Well, this vehicle code section states any person arrested on ANY violation of the California Vehicle Code shall be brought before a magistrate in the county where the offense was committed if the arrested person fails to produce a driver license or other satisfactory evidence of his identity. Any section means, jaywalking, pedestrian in the roadway ,etc.......and arrested does not mean taken into custody, a ticket is a convenient form of arrest.
So in essence what the new policy has done has restricted the officers from using CVC section 40302(A). I asked the chief if he thought that was restricting his officers. He stated "No, because I never heard of one of my officers using that section". The chief danced around the issue and would not answer my question directly, did he feel the new policy restricted his officers? I don't know he wouldn't answer me directly.
This vehicle code section is a great tool for law enforcement. It allows officers to take suspects into custody who have only committed infractions. The benefit of this is to allow the officer to fingerprint the subject to determine his identity. Officers in Orange County can no longer use this section thanks to this new policy.
All the people who read this need to call their local police chiefs and demand this policy be dropped immediately!!!! And don't let them lie to you! Have the knowledge when you call otherwise they will try to bully you into thinking like they do.
